Most fans never click it. However, that link sits on top of one of the strictest rules in the adult business. Below, we break down what it requires, who it covers, and where courts pushed back. This is general information, not legal advice.

What Is 2257 Compliance?

The name comes from Section 2257 of Title 18 of the US Code. Congress passed it in 1988 as part of the Child Protection and Obscenity Enforcement Act. Its goal is simple: prove that every performer in sexually explicit content is an adult. Later, in 2006, the Adam Walsh Act added a companion rule, Section 2257A, which covers simulated sex scenes too.

In short, 2257 compliance rests on three duties. First, a producer must check a government ID for every performer. Next, the producer must keep organized records of that check. Finally, every copy of the content must carry a statement saying where those records are kept. The Justice Department’s rules at 28 C.F.R. Part 75 add the details.

Who Counts as a Producer?

This is where many people get surprised. The regulations split producers into two groups. A primary producer is anyone who actually films, photographs or digitizes the explicit content. A secondary producer is someone who publishes, reissues or uploads that content for commercial use, or who manages the explicit content of a website. One person can be both.

That said, some roles are left out. For example, the law excludes plain distribution, film processing and internet access providers. It also excludes hosting content “without selection or alteration” of it.

What 2257 Compliance Records Must Include

According to 28 C.F.R. 75.2, each performer’s file needs their legal name and date of birth. The producer must get these by examining a picture ID before the shoot. In addition, the file must hold a legible copy of that ID. It must also list every other name the performer has ever used, including stage names, nicknames and maiden names.

The ID itself has rules, too. It must be government-issued, show a photo, name and date of birth, and be valid on the production date. Passports, Green Cards and state driver’s licenses all qualify.

Furthermore, the records must include a copy of the content itself. If it is published online, the file also needs the URL. For live streams, the producer keeps a clip long enough to identify the performer. Meanwhile, secondary producers can rely on copies of the primary producer’s records.

Records must also last. Under Section 75.4, each record must be kept for seven years from its creation or last update. If the business closes, the records must still be kept for five more years. An outside custodian of records can hold them instead.

The 2257 Label on Every Page

Next comes the label that fans actually see. Under Section 75.6, the statement must appear on every copy of the content. Online, that means every web page where an explicit depiction appears. The statement names the work or an ID number for it. It must also give a street address for the records, and a post office box does not count.

Even the font matters. The text must be at least 12-point type, or no smaller than the second-largest type on the material.

Penalties and What the Courts Struck Down

The stakes are high. A first violation of Section 2257 can bring up to five years in prison, and a repeat offense brings two to ten years.

Still, the rule has not escaped legal challenge. The Free Speech Coalition and other plaintiffs sued in 2009. In 2016, the Third Circuit held that the warrantless inspection provisions were facially unconstitutional under the Fourth Amendment. In that 2016 opinion, the court also noted that the government acknowledged no inspections had taken place since 2007.

Then, in a September 2020 ruling, the same court found the ID, record and label duties unconstitutional as applied to the specific plaintiffs. The government had conceded the rules need not apply to clearly visible performers aged 30 or older. However, the court refused to strike the law down for everyone. It also threw out the nationwide injunction. In other words, the record-keeping duties still apply to producers who were not part of that case.

Why It Matters for Creators and Fans

Today, payment networks add another layer. In April 2021, Mastercard announced that adult sellers must have documented age and identity checks for everyone depicted and everyone uploading. It also requires review before publication. We covered how those card rules shape creator income in our guide on how adult creators get paid.

For creators, the practical lesson is clear. If you film a collab partner, you may be acting as a primary producer, so ID checks and release paperwork matter. For fans, a visible 2257 statement is a good sign that a site takes performer safety seriously. Finally, keep in mind that 2257 checks performers, not viewers. Viewer checks fall under separate state and national rules, which we explain in our guide to age verification laws.

2257 compliance explained: who counts as a producer, which performer ID records to keep, how the 2257 label works, and what courts struck down.

[71
160,159,161,164,166,162,163,123,165
post-298","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-industry-explainers","tag-18-u-s-c-2257","tag-2257-compliance","tag-2257-records","tag-adult-content-law","tag-adult-creators","tag-custodian-of-records","tag-free-speech-coalition","tag-mastercard-adult-content-rules","tag-performer-age-verification

2257 Compliance Explained: Records, Labels &
