This is general information, not legal advice.<\/p>\n<h2>What Is a DMCA Takedown?<\/h2>\n<p>A DMCA takedown is a request from a copyright owner asking an online service to remove material that infringes their work. The rules live in <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/17\/512\" rel=\"nofollow noopener\" target=\"_blank\">Section 512 of the US Copyright Act<\/a>, part of the Digital Millennium Copyright Act.<\/p>\n<p>Here is the trade-off behind it. Section 512 gives online services a &#8220;safe harbor&#8221; from money damages for what their users upload. In return, they must remove infringing material quickly once they get a proper notice. As a result, most hosts, tube sites and search engines take these notices seriously.<\/p>\n<p>That said, the <a href=\"https:\/\/www.copyright.gov\/512\/\" rel=\"nofollow noopener\" target=\"_blank\">US Copyright Office<\/a> points out that responding is always voluntary. A service that ignores a notice simply loses that liability shield.<\/p>\n<h2>What a Valid DMCA Takedown Notice Must Include<\/h2>\n<p>According to the Copyright Office, a notice must contain &#8220;substantially&#8221; six things:<\/p>\n<ul>\n<li>Your physical or electronic signature, as the owner or an authorized agent.<\/li>\n<li>Identification of the work being infringed. For many works on one site, a representative list is enough.<\/li>\n<li>Identification of the infringing material, with enough detail to find it. In practice, that usually means exact URLs.<\/li>\n<li>Your contact information.<\/li>\n<li>A statement that you believe in good faith the use is not authorized.<\/li>\n<li>A statement that the notice is accurate and, under penalty of perjury, that you are authorized to act.<\/li>\n<\/ul>\n<p>Notably, you do not need to register your copyright first. You also do not need a lawyer. However, registration is required before you can sue in court over a US work. In addition, knowingly making a false claim can leave you liable for damages and legal fees.<\/p>\n<h2>Where to Send It<\/h2>\n<p>Next, find the right inbox. Services that host or link to content must register a DMCA agent with the Copyright Office to keep their safe harbor. You can search those agents in the Office&#8217;s public DMCA Designated Agent Directory. Sites must also post the agent&#8217;s contact details publicly, often in their terms of service.<\/p>\n<p>Many sites also offer their own DMCA webforms, which may be faster. Search engines work the same way. For example, <a href=\"https:\/\/support.google.com\/legal\/answer\/3110420?hl=en\" rel=\"nofollow noopener\" target=\"_blank\">Google&#8217;s legal removal page<\/a> asks for the specific URLs, not just a home page, and sends a reference number for each request. Keep in mind, though, that removing a search result does not delete the file from the site hosting it.<\/p>\n<h2>Counter-Notices: When Content Comes Back<\/h2>\n<p>After removing content, the service must promptly tell the uploader. The uploader can then file a counter-notice if they believe the removal was a mistake or a misidentification. That counter-notice must include their name, address and phone number. It must also include a statement under penalty of perjury and consent to a federal court&#8217;s jurisdiction.<\/p>\n<p>Then the clock starts. The service must restore the material in no less than 10 and no more than 14 business days. The only exception is if you tell the service you have filed a court action. For smaller disputes, the Copyright Office also runs the Copyright Claims Board, a lower-cost option for claims of up to $30,000 in total.<\/p>\n<p>Meanwhile, repeat uploaders face consequences. To keep their safe harbor, services must adopt and enforce a policy that terminates repeat infringers. You can also ask a federal court for a subpoena that orders a service to identify an alleged infringer.<\/p>\n<h2>When a DMCA Takedown Is Not the Right Tool<\/h2>\n<p>Here is the catch many people miss. Only a copyright owner, or their agent, can send a notice. If you filmed the video or took the selfie, you likely own it. If someone else pressed record, however, you probably do not. In that case, the Copyright Office points to state privacy, right-of-publicity and revenge porn laws instead.<\/p>\n<p>Fortunately, a newer federal law now fills part of that gap. The TAKE IT DOWN Act was signed on May 19, 2025. Since May 19, 2026, the <a href=\"https:\/\/www.ftc.gov\/business-guidance\/resources\/complying-take-it-down-act\" rel=\"nofollow noopener\" target=\"_blank\">FTC has enforced its removal rules<\/a>. Covered platforms must offer a clear way to report intimate images shared without consent, including AI-made fakes. After a valid request, they must remove the content and known identical copies within 48 hours. Violations can bring civil penalties of $53,088 each.
